Derrick and I discussed this and we determined that “does not allow attachments to City Traffic Signal Poles” includes any pole with a traffic signal head on it.Street lights at intersections will be reviewed on a case by case basis using other nondiscriminatory requirements listed.

Several reasons:
-
We don’t want services provides working at intersection affecting or blocking the view of the traffic signal when they’re servicing their equipment
-
We don’t want to have other entities using our traffic signal conduit and pull boxes to access poles. Adam says applicants are required to use their own conduit and pull boxes. We have to make changes and troubleshoot problems much more frequently than street lighting, and it complicates things when there are other cables present.
-
Poles at busy intersections are much more frequently knocked down than streetlight poles, and we need to service the poles quickly and not worry about other equipment.

The below application and guideline “does not allow attachments to City Traffic Signal Poles”. Mike and I have been thinking that our practice was to not allow on traffic signal poles say a 1A-10.However, there have been some permitted locations on the top of the luminaire part of pole on say 19-2-100. What is your rationale for not allowing on streetlights at signalized intersections? There are some relevant catch-alls re traffic sign visibility/safety but depending on your concern… that guideline may need to be updated.We can discuss after you’ve had chance to review below.Thanks,

I reviewed your template and sent a new City template to the City Attorney’s office for their review.I am hoping that AT&T can use City template and propose minor edits.I suspect the City Attorney should be able to complete the template in two weeks.Then you can finalize the license for AT&T review once you have complete permit application.The license will need to go to City Council which generally has a 3-week lead time from delivery of executed license on your end.So I’d say we are looking and end of May on execution of license.
I’ll follow up in two weeks if not sooner.

I was forwarded your question from Emmitt Carlton at the FCC’s intergovernmental affairs office, and he asked me to follow up on your behalf given the amount of work the National League of Cities does with the FCC. I apologize for the delay!
RF Emissions:
The short answer is that there isn’t a guide specific to 5G technology and RF exposure. The much longer, and possibly more helpful answer, is that there is a guide for local government officials, but it was put out by the Local and State Government Advisory Committee in 2000, and obviously is pretty outdated.
However, the general policy issues hold, and it may be a helpful resource: http://wireless.fcc.gov/siting/FCC_LSGAC_RF_Guide.pdf Additionally, the folks I’ve spoken to in the engineering office have noted that they work to make the guidance device-agnostic; there would not necessarily be separate standards for small cells or 5G equipment, just a determination of whether a given piece of equipment meets overall emission standards.
You should also be aware that in August, the FCC Chairman proposed maintaining the existing standards, but it is unclear whether this proposal encompasses RF-emitting infrastructure and not just cell phones.
NLC has continued to press the FCC to update its current standards, which were adopted in 1996, and Chairman Pai’s proposal reflects action in a docket that has been open since 2013.
We’ve seen a bit of political hot-potato between the FCC and the FDA on any possible update for a number of years now. Other action in that docket (ET Docket NO. 13-84) of interest is this note from the Institute of Electrical and Electronics Engineers (IEEE) with its own updated standard on RF emissions. As the IEEE notes, their previous standard from 1991 was used to create the 1996 federal standard, so an update seems noteworthy, but I am not an engineer and don’t know what, if any, substantive differences exist between the two.
I’ve also seen in the docket some communication from industry and other engineering groups indicating that the overall age of the standards is causing a consumer confidence problem – which is likely what you’re seeing on the ground – and have also urged the FCC to update standards and guidance.
The bottom line is that this is a policy problem of which the FCC is aware, but has no immediate plans to resolve. I encourage you to communicate formally with the FCC and your congressional delegation to continue pressing the issue, and to the extent that you get concern from residents, educate them about the federal government’s responsibility in this area and encourage them to contact their federal policymakers as well.
Buildout/Implementation Timelines:
Again, we (and the FCC) don’t have any information about the scope or timeline of deployment beyond what the carriers make available. Something that has been a bit of a sticking point is the extent of actual 5G network reach in those cities and NFL stadiums where it has been launched, but almost certainly most of the equipment you are seeing is 4G network densification that may also support 5G networks in the future. Unfortunately, there is not any official resource on an overarching national plan for 5G deployment.

I manage permitting in the public right-of-way and have some information on small cell facilities.
See attached list of small cell facilities currently under review.There may be some additional sites not in the street or prior to when we tracked in this fashion.
The City only has so much local control of these installations but generally our preference is that the small cells are attached to City street lights to avoid additional clutter in our streets.I can share our standards with you if you’re interested.
The sites you mention on State Street, I believe are a form of small cell facility.They are owned by Crown Castle and significant effort went into the aesthetic design.

I’ve seen two towers on State Street that I’ve been wondering about. Tall and all dark green with a long canister at the top. There is one in front of McConnell’s Ice Cream downtown and one in front of Benchmark Eatery Restaurant on State Street (Cross Street Anapamu).
I’ve been looking into this and there are serious health concerns about this 5th Generation Wireless Technology that is being installed across the world. Large masses of concerned residents in countries and cities are speaking out to stop it and there have been more and more success stories about putting a stop to it until there has been 3rd party studies done on this new band of the electromagnetic frequency spectrum. Cell phones, wifi and current cell phone towers are already harmful. This is exponential invisible radiation being added to our environment without our consent. There are at least 2 dozen lawsuits against the FCC in the USA about this.

I found your contact information online and am reaching out to you in an effort to gather some information and find out who an appropriate FCC local contact would be for our City…
As I am sure you can imagine our City is impacted by the FCC’s various rulings to facilitate deployment of small cell facilities.We have a published application and guideline (https://www.santabarbaraca.gov/civicax/filebank/blobdload.aspx?BlobID=219251, not for review but information) and are receiving applications and have at least one project that has been completed.
So I located below guide on RF exposure: https://www.fcc.gov/consumers/guides/human-exposure-radio-frequency-fields-guidelines-cellular-and-pcs-sites as that is a question that often comes up.
We often get constituent inquiries on scope and timelines of implementation that we can’t answer.Sometimes the carrier or provider provides unclear or conflicting information… Is there a similar guide or information available to share with the general public re timeline for implementation of 5G?Our local permitting helps us understand construction timelines but not when new networks go live to the consumer.
Please forward to appropriate party of respond as I have been tasked with developing a City email response to constituents on this subject.

I am requesting a meeting to discuss our efforts to secure a Master License Agreement (MLA) with the City of Santa Barbara to proceed with our small cells build. We have not been successful thus far in obtaining feedback on our proposed MLA that we have shared with Michael Cloonan in Public Works.
While Mr. Cloonan has been wonderful to work with and communicates regularly with us, he has not been able to provide us with comments on the MLA. Typically an MLA will ultimately be addressed by the City Manager (and/or the City Attorney), so would you be amenable to either meeting with me to discuss this, or direct me to the appropriate person for this meeting request? We are seeking to submit permits as early as next week and this issue is hindering that effort.

Perhaps we can do a to discuss the below responses:
- I don’t see how the "agreement" addresses small cells not on City vertical infrastructure. As such, I’m not following the "Contracts Clause" effect on SB 649 for wireless equipment on their own vertical infrastructure etc.
Language can be attend to market all city-owned property, real property and vertical infrastructure included, for the sake of wireless antenna attachments.If 5 Bars has the exclusive right to market all city-owned property to be used for wireless equipment, then its agreements with cities can be defended under the Contract Clause, as the US Constitution seeks to protect contractual expectations of economic opportunity.The agreement thereby requires applications for wireless antenna attachments to be directed through 5 Bars.
- I note that the "agreement" does not appear to have adequate termination provisions.
We are amenable to inserting the following language”
"Notwithstanding the foregoing, Licensor may terminate this Agreement without cause and without prejudice to any other right or remedy of Licensor, by giving Licensee ninety (90) days advance written notice from the City Manager.In such case, Licensor shall not pay damages, costs, or other payments due Licensee except for any percentage payment due to Licensee for any agreements approved by the City Council on a date prior to date of termination of agreement."
- Is 5 Bars an agent of any wireless service provider?

As mentioned in the dept. heads meeting this morning, this item (No. 2) may be discussed in relation to SB 649 – Wireless Telecommunication Facilities. Attached is the bill as most recently amended. It seeks to significantly curtail local control over access to public rights of way, fees charged and the level of discretionary review.
I thought you might want to see the text in advance of the meeting next Tuesday. The City (Mayor) submitted a letter in opposition of this bill (see attached).
